Yaz, Yasmin and Ocella Lawsuits Continue to Pile Up

Thursday, December 17th, 2009

Due to the large number of lawsuits involving Yaz, Yasmin and Ocella, the cases are being handled as multidistrict litigation. Multidistrict litigation refers to a procedure in which the federal court system transfers all pending civil cases with similar circumstances to one judge.

To date, hundreds of women have filed lawsuits against Bayer HealthCare Pharmaceuticals for a range of injuries they claim to have been caused by the birth control pills, Yaz, Yasmin and Ocella (the generic form of Yasmin). Some of the potential health risks associated with these birth control pills include:

  • Blood clots
  • Pulmonary embolism
  • Deep vein thrombosis (DVT)
  • Heart attack
  • Stroke

Plaintiffs across the country are complaining that Bayer failed to warn consumers of the severity of the potential health risks associated with both pills. Injured parties are seeking compensation from Bayer for their physical injuries, pain and suffering. Lawsuits have been filed on behalf of women in all age groups who have allegedly been harmed by the pills.

Multidistrict Litigation vs. Class Action Suits

Multidistrict litigation is often confused for a class action lawsuit. However, there are some important differences. The main difference is that in a class action suit, a few individuals file a claim on behalf of multiple other people or the “class,” whereas in multidistrict litigation, each plaintiff maintains his or her individual claim. Most multidistrict litigations occur in federal court.

Yaz Lawsuit Filed for Deep Vein Thrombosis

Thursday, December 17th, 2009

An Ohio woman, claiming to have suffered deep vein thrombosis (DVT) from Yaz birth control pills, joined the other hundreds of women who have filed injury lawsuits against makers of the popular contraceptive, Bayer HealthCare Pharmaceuticals. The lawsuit was filed in November 2009 with the Superior Court of New Jersey by 30-year-old plaintiff, Mae Walker.

Lawsuit Claims Yaz Caused DVT

According to the Yaz lawsuit, Walker had to be hospitalized for three days for DVT. As a result of her injuries, she is now required to take a blood thinning medication, which she may have to take for the rest of her life. The lawsuit also states that her injuries have resulted in physical pain and will prevent her from lifting heavy objects.

The lawsuit claims that Bayer failed to properly warn users of potential health risks such as deep vein thrombosis, heart attack, stroke, blood clots, gallbladder disease and death. To date, more than 300 women have filed similar complaints against Bayer.

Deep vein thrombosis is a condition in which blood clots form in a deep vein (typically in the legs). Symptoms of DVT can include severe pain, redness and swelling at the injury site. If the blood clot dislodges, it could travel to the lungs and result in sever injuries and death. This is referred to as a pulmonary embolism.

Woman Files Yaz Lawsuits After Developing Blood Clots in Her Lungs

Wednesday, December 2nd, 2009

Personal injury lawyers across the nation are investigating Yaz lawsuits on behalf of hundreds of women who claim they have been injured as a result of taking the birth control pill, Yaz. Produced by Bayer HealthCare Pharmaceuticals, Yaz birth control has been in the legal spotlight since it has been linked to side effects including blood clots, heart attack and stroke.

One of the most recent lawsuits against Bayer was filed in November 2009 on behalf of a woman who claims she developed blood clots in both lungs as a result of taking Yaz. The lawsuit claims that the plaintiff, Lottie Green, 41, developed a large blood clot in her left lung and multiple smaller ones in her right lung after taking the oral contraceptive. According to the lawsuit, Green spent six days in the hospital where she was treated for the blood clots.

Yaz Blood Clots and Other Cardiovascular Side Effects

It has been proven that all oral contraceptives put women at risk of health risks. In fact, Bayer lists blood clots as one of the potential side effects of taking Yaz and any oral contraceptive (OC) on its website, along with other cardiovascular side effects including heart attack and stroke. Bayer warns that women over the age of 35 who smoke are at a higher risk of cardiovascular side effects.

Yaz Lawsuit Filed on Behalf of 15-Year-Old Girl

Tuesday, December 1st, 2009

A woman filed a lawsuit against Bayer HealthCare Pharmaceuticals on behalf of her 15-year-old daughter who allegedly sustained injuries as a result of taking Yaz birth control. The lawsuit claims that Katie Kraus suffered from cardiac arrest, three times, and had to undergo emergency surgery for blood clots in her pulmonary arteries. Katie has been taking Yaz for six months prior to her injuries.

The lawsuit, filed by Katie’s mother, Dana Kraus, claims that Katie was complaining of severe chest pain and feelings of suffocation. Dana said her daughter faces the potential of life-long challenges with pancreatitis, liver function problems and acute renal failure. The plaintiff seeks more than $150,000 in compensation for her daughter’s injuries, plus punitive damages and the cost of filing the lawsuit.

According to the lawsuit, Bayer failed to properly warn women of the potential dangers associated with Yaz. The lawsuit involves several other women who also claim to have been harmed by Yaz.
